he's jailed on three misdemeanor charges including attempted stalking. look at hurricane bill, show you that here in a moment, he is looming large and getting stronger in the atlantic ocean as well. meteorologist chad myers has been looking at a projected path and how much stronger they believe it's going to get. where do you at this point see it heading? >> it is still heading to the west northwest. it is still i believe going to miss the west indies. going to miss the british virgin islands and anila and especially bones and into puerto rico. there's the storm right now at 105 miles per hour. the storm has to make a curve around a high pressure that is still anchored, christi, right here, and it will not make this curve that is forecast until this high moves to the east and allows the turn to do this. here's the circulation that we're hoping for when the high moves to the east.
12:38 pm
here's the circulation. here's the circulation we have now, and if you notice the difference, this circulation would drag the storm farther to the west, but when this high does this, then all of a sudden this westward part of the component of that wind will now be a south and southeastward part, and it will turn around, so that is some of the good news. it is also forecast to be 125 miles per hour, 120 as it makes a run at bermuda. bermuda still in the cone. i just want to stress the united states, no matter what you've heard, has never been in the cone. the u.s. east coast has never been any part of any forecast model yet. earlier today a little bit of yesterday models were trying to bring it closer to north carolina and maybe making a swing at the little tip here maybe of eastern long island and into massachusetts. that's still a possibility, but i would say the possibility of that is still 1% to 2% because
12:39 pm
the rest of the models all take it and turn it. got to be one of those waiting games. does the high get out of way in time? if it doesn't at least we'll know with many days in advance because that sunday before it gets to determine did a. even if it would try to turn or not turn into the u.s. we would still have another four to five days notice and figure out where this thing is going. that's why it's so hard and people say how come you can't be more accurate with this? how come you don't know what that high is going to do? >> it's early on. >> who lives out here in the middle of the atlantic? how many weather balloons can you send up in the middle of the atlantic to know what the atmosphere is doing? >> good point. >> zero, we just don't have the data necessary to figure out whether this actually -- this high is going to get out of the way or not. all of the forecast models say so far so good. bermuda, still need to be watching out for this. >> sure. you said 125-mile-per-hour winds, what category does that make it? >> a category three. 105 and to get to category three you only need to get to 1111 so
12:40 pm
we're only six miles agrey that right now and some of the computers get up to 140 miles per hour. that would be the next category past three but we don't need to worry about that. so far that's where the fish will be affected. we'll call that the fish storm. bermuda, they don't want a category four anywhere near that island. >> chad, thank you so much for bringing us up to speed as always. >> you bet. if a business closes before you get there, usually not a matter of life or death. not always. the texas judge is on trial for closing her court exbeing actly at 5:00 p.m. what that meant for a convicted killer and what charges the judge is facing.

well, later this afternoon a judge is expected to rule on a controversial anti-abortion law in oklahoma. it forces women to get an ultrasound before an abortion. critics say the law is unconstitutionally vague, that it doesn't spell out what doctors should tell women who are undergoing the ultrasound. proponents say it requires doctors to describe the fetus, its dimensions, its heart activity and other physical details. the state lawmakers originally passed the major by overriding governor brad henry's veto. henry argued it was unconscionable to require victims of rape and incest to undergo the ultrasound. what do you think? this is a very sensitive issue? do you believe an ultrasound should be required before a woman has an abortion? do you think it gives a woman perspective say, an informed choice, or does it infringe on her right to choose? call us at 1-877-tell-hln or e-mail cnn.com/hln or text the word views.

a disney world performer is dead after suffering a head injury after a rehearsal. it's the park's third death in less than two months. john has more from orlando for us right now. john, boy, what is the park saying at this point? >> well, the park at this point, they have issued a statement to the family saying that their hearts and their prayers and their thoughts are with the family, their friends, and the co-worke co-workers. this particular accident seems to have been -- we don't know the exact detail. this is a tumble role this performer had performed last night. right after the incident he was transported to the local hospital, celebration, florida, which is just across the street from disney world. they're still continuing to investigate. they did say to me this morning
2:11 pm
exactly how long the employee, he was 30 years old, and he had worked at the indiana jones epic stunt spectacular, and they're not completely sure what caused the accident. they did notify the sheriff's office and also osha. >> okay. what are other employees there saying because when you're talking about three people dying in the last couple of months, i have to think that shakes your nerves a little bit. >> exactly. well, what had happened, the first accident in this particular round of these three was that on july 4th late into that evening, actually into july 5th, when things were closing up, the monorails were parking for the evening and there was a miscommunication. there was an accusation someone wasn't at their post, missed radioed information, but a metro
2:12 pm
rail train backed into another one and killed a 21-year-old. they found out later that -- like i said, there were many miscommunications. at that point the national transportation safety board has begun an investigation and disney says they are providing all information that they can and the safety board is looking into the history, the training of the metro rail -- of the monorail, and they were -- this is one of the first accidents with the monorail in the history since disney had opened, and last week another employee had passed away after he had fallen the week before by slipping on water on a stage flt he was teachi teaching kids how to play with swords. when he slipped on the water, he fell and hit his head into a wall. people didn't expect he was going to pass away. he had some complications after being in the hospital for four
2:13 pm
to five days and suddenly took a turn for the worse and passed away. >> john, thank you so much for bringing us the very latest there from orlando. we appreciate it. okay. let's talk money. fewer new homes are being built. housing starts fell 1% last month. even as demand for new homes remains a bit sluggish, there is hunger for another kind of property, foreclosures. poppy harlow from cnnmoney.com has more on that from new york. i'm sure people are thinking i'm going to go out there and get a great deal. >> christi, often it can be a great deal. we're getting more and more information about these foreclosure sales. some closing within a day of hitting the market. some really in just a matter of hours. according to foreclosures.com some of those homes in foreclosure are going into contracts less than 90 minutes after they hit the markets. it's unbelievable. one of the big drivers is the banks that are pushing the prices on these homes lower to get them off their books and out
2:14 pm
of their hands. now, banks have to pay property taxes, the maintenance, energy bills on a home when they take it over, and those costs really pile up. what we're seeing especially happen here is this is happening more and more where prices are being pushed down in the bubble markets like california, like florida, but it's really not just happening with foreclosures when you talk about prices falling. homes in general continue to see their values fall. when you look at one real estate tracker, they said about 25% of homes on the market today have had their price cut at least once to try to attract buyers. in fresno, california, that's really accentuated with a 67% increase in price reductions just from june to august, but the deals, of course, christi, can be even better with those foreclosures, especially when the banks just want to get rid of the houses and find some buyer. >> sure because they want to try to start balancing their books. but there are risks, we know, in buying foreclosures. will you give us some idea of what we need to be looking out
2:15 pm
for here? >> if you're eyeing a few homes for potential buys, make sure to get them inspected. you never know what kind of shape they will be in. be prepared for higher than average maintenance costs for the first three to five years on a foreclosure. think about it, right, if someone couldn't pay their mortgage they're generally not keeping up their house much either. be prepared for higher maintenance costs. and then go over the deal very, very carefully. if you're buying a foreclosed property from the bank, there can often be some confusing language in there. sometimes it works more to the bank's advantage than your advantage. i think it's definitely worth the cost of a lawyer, the fees along with that, to get some expert insight on this. they can be great deals. there's a lot to look out for. it's all explained in this article on cnnmoney.com. we're seeing more and more people scooping them up. >> poppy harlow, good to see you. thank you so much. and you can get much more business news at cnnmoney.com. a website may be a college student's only hope for a normal

hln. two young children are back with their mother thankfully after being abducted overnight from their home in phoenix. but police say the children, ages 2 and 11 months, were taken by heavily armed men during this home invasion. there's the 2-year-old. they believe the case started as an attempted robbery. the children were eventually dropped off at a house in south phoenix, but the suspects had not been caught here. the mother was not hurt. the children appear, as you can see, to be okay. police do not think that the mother knew those suspects though. much of the debate over health care reform has centered on a government-funded plan, a so-called public option, but over the weekend it seemed that the white house was backing away from that. then again maybe not. deputy political director paul steinhauser is in washington with the latest. this keeps going back and forth and back and forth. where do they stand? do we know? >> kind of a controversy here. have they packed off the public option or not?
2:35 pm
it started on "state of the union" with john king. kathleen sebelius was a guest and she said that the public option was not the essential element in health care reform. this morning she had a very different opinion. take a listen. >> all i can tell you is that sunday must have been a very slow news day because here's the bottom line. absolutely nothing has changed. we continue to support the public option that will help lower costs, give american consumers more choice, and keep private insurers honest. if people have other ideas about how to accomplish these goals, we'll look at those, too, but the public option is a very good way to do this. >> the public option has really become the lightning rod in this big battle we have seen playing out at town halls across the country over health care reform. republicans, they're pretty much dead set against the public
2:36 pm
option. they say it will take away -- it will basically mean government control and it will force private insurance companies out of business. democrats, there's been a lot of pushback after this coverage over the weekend. a lot of pushback by liberals saying a public option must be in whatever health care plan is finally agreed upon. >> we keep talking about sebelius, about you she's not the only one that's been saying the public option might be off the table, is that right? >> you are absolutely right this. started in saturday on colorado. president obama has holding a town hall in grand junction, colorado, and he said at the time and during that town hall the public option, whether we have it or don't have it, is not the entirety of health care reform. the next day he had a 1,200 op-ed in "the new york times" and the public option did not come up once. you couple that with what sab l sebelius said. that's why the media was really saying has the white house walked away from the public option? just moments ago at the white house briefing the press secretary robert gibbs said, listen, there is no change. we've been saying this kind of thing for months now.
2:37 pm
we have not said yes or no on a public option. nothing is final. >> okay. well, hopefully we'll figure out who is final in the next few weeks, paul steinhauser. thank you so much. >> thank you. >> sure. well, a man carrying an assault rifle was among a dozen protesters carrying guns outside president obama's speech to veterans yesterday in phoenix. this is the second time in the last few days someone openly carried a gun at a presidential event. want to point out no laws were broken, but police were very close. >> i come from another state where open carry is legal, but no one does it, so the police don't really know about it and they harass people, arrest people falsely, and i think that people need to get out and do it more so they get kind of conditioned to it. >> police were watching closely in phoenix. the secret service says no one carrying a gun is going to get close to the president. anywhere the president appears is a federal site while he's

3:49 pm
some homes in foreclosure are in contract to be purchased less than 90 minutes after they hit the market. the big driver is the banks. they're driving the price of the homes further and further down in order to get them off their hands. banks have to pay property taxes. they have to pay the maintenance and energy bills when they seize a home. the more they have to pay out. this is happening especially in hard hit markets with a lot of foreclosures like california and like florida. but it's actually not just foreclosures. what we're seeing is evidence that home prices are being driven down. really across the board. there's a real estate tracker that says that about 25% of homes on the market right now across the u.s. have experienced at least one price cut. in fresno, california, that's ak sen -- 67% of homes seeing a price cut more than once from june to august. the foreclosures can be the best tout there. >> so what are the risks of
3:50 pm
buying a foreclosure? >> huge risks. you might get a good deal. you have to have the home inspected carefully. it may not have been to when yo. also, be ready for costs to keep up the house to be higher for generally the first three to five years on a foreclosure. if you think about it, someone couldn't pay their mortgage, they're probably not replacing the furnace or keeping up the home that well. also, look over the terms of the deal really well before you buy a foreclosed property because sometimes when the banks are doing these deals, they can put in language that you might not understand or may be to their advantage, not yours, so it's worth the cost of a lawyer to look them over. more and more deals out there and the take-away from this really is people are picking them up in a matter of days, if not hours. >> they're pretty much sold as-is, right? >> reporter: oh, yeah, take it or leave it. >> leaky roof, you fix it. poppy, thanks. great to see you. all the business news up to the minute on cnnmoney.com. check it out. let's check out wall street

want so badly to be parents and cannot have children, and i am one of those people. i can no longer have children. i had a son back in 2001 that died of, you know, heart complications and that was my one chance. >> so you're thinking, that's a horrible thing you went through but if you're thinking if they had the ultrasound it might be a deterrent or make people think twice before they went through with it. >> caller: absolutely. >> thank you. got to move on. thank you for your phone call and for sharing something so personal. jill is calling from glendale, arizona. did you hear what angela was just telling us? where do you stand on this? >> caller: yes, i agree 100%. >> okay. >> caller: i think that abortion is a very, like you said, it's a very tough, hard issue, sensitive issue, but i know people that have used this multiple times for birth control
4:13 pm
and this is an innocent child. if this, you know, the fetus is not born yet but give it the opportunity. i mean, if pregnant women -- >> so are you basically saying that since you agree with melissa, you think if women actually saw the ultrasound, they might see what they're going through with? >> caller: they would no doubt in their mind, this is a formless blob of nothing or is it going to -- is it alive, can it actually feel the pain, can it, i mean -- >> jill, i will have to let you go. i appreciate exactly what you're saying, though. i appreciate your point of view. but we have a lot of people that are really passionate about this, just like you are. it's been a really hot question today. i posted it on my facebook page and got a ton of responses. this is just a few that we picked out. trudy wrote absolutely not. the decision to have an abortion is agonizing enough without a
4:14 pm
forced ultrasound. thanks. it's ridiculous. judy disagrees, writing i think it is a great thing to do the ultrasound before an abortion. maybe these people will realize there's a living human being in their body. so she agrees with a couple of the callers we just had. thanks for your e-mails and phone calls today. we still want your comments here at hln news and views. prime news starts at the top of the hour. lots of topics on prime news, you can comment on and discuss it with mike galanos. check them out and see how you can get your view heard. michael jackson's doctor is finally speaking out. what he is saying to patients and friends on a video he just posted on youtube.
4:15 pm
4:16 pm
michael jackson's personal physician is breaking his silence nearly two months after the singer's death. dr. conrad murray just posted a video on youtube today. he addresses his supporters. ted rowlands is in los angeles with the latest. i'm sure everyone, you included, have been asking for an interview. this is the route he chose, ted. >> reporter: yeah, multiple times, actually. yeah, and you know, this is a very controlled environment. obviously, they filmed, videotaped this message, they said they did it last wednesday in houston and edited it to what they wanted, then they released it today about three and a half hours ago. what they did, they put it on youtube, they sent the link out to his patients and supporters,
4:17 pm
although they would have full knowledge it was going to get leaked into the mainstream media very soon and indeed, it has. here is the message now. he starts by thanking his supporters but then at the end, listen, he talks about how he says he is telling the truth. >> i want to thank all of my patients and friends who have sent such kind e-mails, letters and messages to let me know of your support and prayers for me and my family. because of all that is going on, i'm afraid to return phone calls or use my e-mail. therefore, i recorded this video to let all of you know that i have been receiving your messages. i have not been able to thank you personally, which as you know, is not normal for me. your messages give me strength and courage and keep me going. they mean the world to me. please don't worry. as long as i keep god in my heart and you in my life, i will
4:18 pm
be fine. i have done all i could do. i told the truth and i have faith the truth will prevail. god bless you and thank you. >> reporter: now, richelle, dr. conrad murray's attorneys say that over this past almost two-month period, they have been getting phone calls every day from supporters. they say every day, somebody spreads a rumor that he's either committed suicide or is on suicide watch, and this was their way of sort of telling everybody that supports him that he is okay. but clearly, from a p.r. standpoint, it was a good move to humanize him because all that we have seen of him are still photos and we are hearing all of these things that he allegedly did in the care of michael jackson, so it's a two-fold message here. as far as the investigation goes, they say it has no timing connected to it. i asked did you release this because you think maybe he's going to be arrested in the next few days and you wanted to get something out there on the record. they said no, the investigation
4:19 pm
has nothing to do with the timing. we just thought it was time for him to say something to folks that are supporting him and clearly, to everybody else. >> like you said, it does at least make him human, if nothing else. what do you know about when michael jackson will finally be buried? it has been a long time. >> reporter: yes, it has. finally, the family has made definitive plans and they have released it in a press release. they are going to bury him on his 51st birthday which is a week from saturday. it will be a private burial at the forest lawn cemetery in glendale, which is in the los angeles area, starting at 10:00. but it will be private. clearly, after a lot of thought and a lot of different ideas, they have come to an agreement and that's their plan, to bury him on what would have been his 51st birthday. >> exactly what that day is. it's going to be private. all right, ted, great wrapup today. thank you. >> reporter: you bet. talk about an unpleasant surprise in your front yard.
4:20 pm
not a robber. a huge 11-foot python. california homeowner was on his porch sunday night when he saw this enormous snake moving across the fenced yard. it took two animal control officers to get the 50 pound snake into a truck. look at it. it's in an animal shelter. authorities say the python was probably somebody's pet. stocks got crushed yesterday as investors got nervous about the economic recovery. today we find out if there has been a change in the mood on wall street. let's hope so, felicia. >> indeed, there has been a change. investors are feeling a lot better after today's closing bell as stocks staged a rebound. earnings reports from home depot and target beat expectations and that helped calm worries about consumer spending. the major averages recouped about half of yesterday's big losses. the dow industrials rose 82 points to close at 9217. the nasdaq composite gained and
4:21 pm
the s&p tacked on 1%. shares of home depot rose 3%. the nation's largest home improvement retailer posted a drop in profits thanks to the dragging recession. results were better than expected and home depot boosted its four-year forecast. we will get an earnings report from computer giant hewlett-packard in a few minutes. that could likely set the tone for tomorrow's session. richelle? >> felicia, thank you. sex or sleep? what's your answer? according to a survey, it's a split almost 50/50. the study was commissioned by westin hotels and about 51% of people preferred a night's sleep to hanky-panky. the survey found 60% of travelers say their pda has kept them from getting a good night's sleep. the man accused of stalking teen star miley cyrus is due in court this hour. police say the 53-year-old man tried to breach security at a movie set off the georgia coast in june. he has been warned to stay away from tybee island.

mike 'ally jackson's doctor is in a new internet video. he says he told the truth. dr. conrad murray is talking for the first time since the pop legend's death. in this video that is posted on youtube. >> i want to thank all of my patients and friends who have sent such kind e-mails, letters and messages to let me know of your support and prayers for me and my family. because of all that is going on, i'm afraid to return phone calls or use my e-mail. therefore, i recorded this video to let all of you know that i have been receiving your messages. i have not been able to thank you personally, which as you know, is not normal for me.

your messages give me strength and courage, and keep me going. they mean the world to me. please don't worry. as long as i keep god in my heart and you in my life, i will be fine. i have done all i can do. i told the truth and i have faith the truth will prevail. god bless you. and thank you. >> of course, authorities have been investigating dr. murray in connection with jackson's death. that was back on june 25th. they say he may have administered a powerful anesthetic to the pop singer the day he died. we have learned that jackson will be laid to rest on what would have been his 51st birthday. jackson will be buried during a private ceremony at forest lawn cemetery in glendale, just north of los angeles. it will be on august 29th. the family spokesperson says the singer will be buried in the cemetery's great mausoleum which
4:32 pm
features art replicas. the ceremony is for families and close friends. one of byrd and melanie billings' children was actually in the room with the couple when they were killed in their home in florida. that's what a nurse who interviewed the boy told police. the nurse said the boy, who has autism and speech issues, told her quote, two bad men wearing black masks came to the room and told byrd billings you're going to die. six men and a teenager are charged with first degree murder and home invasion in the shooting death of the billings couple last month. they have pleaded not guilty. an eighth suspect, a woman, faces a charge of being an accessory after the fact. conservative commentator robert novak has died after a long battle with brain cancer. he was 78. his family says he died today in washington at his home. novak was a fixture on our sister network, cnn's political debate show. n you know the one, "crossfire." readers also followed his column for decades.
4:33 pm
novak found himself at the center of the valerie plame scandal that sent louis "scooter" libby to prison, outing the cia operative in his column in 2003. friends called novak the prince of darkness and he embraced that nickname, using it for the title of his memoir. hurricane bill was looming large, getting stronger in the atlantic ocean so let's check in with meteorologist chad myers. he has a look at its projected path and how much stronger this thing could actually get. hey, chad. >> hello, richelle. the thing could get to be a category 4 hurricane. some of the computer models are making it that large. i think basically all of the reliable ones, though, are keeping it a 3. we have to realize it's 105 miles per hour right now, only six miles per hour from being that category 3. we have a hurricane hunter aircraft in it for the air force hurricane hunter. they have been flying around and have found a few flight level winds to 115 miles per hour. they left out of antigua and are flying through the storm. where exactly is it?
4:34 pm
well, we will drag our storm pulse.com map here and show you exactly where it is. there's bill. here's san juan. if i touch san juan, i can get an estimation of about 1,047 miles from san juan, from bermuda proper, 1474 miles. it's still a long way out there, still has a long way to go and the computer models are still not taking it to the u.s. pretty close to bermuda, though. now, this could still shift a little bit to the left. these are all the computer models and what they say, what they believe is going to happen from where bill is here. you have to realize, this is still about 100 hours out, less than five days, but the air five days out in a computer model could be here or could be here. i don't believe it's going to the u.s. just yet, but still, as this gets closer, we'll see whether the big turn, as we call it, actually takes place. richelle, what happens is that there's a high pressure right here. that high pressure is blowing the wind like this, and so if
4:35 pm
the high never moved like it did in andrew, this storm would follow this wind and head toward the west, or the u.s. that is not the forecast. the forecast is for the high pressure system to move well into the atlantic and turn like this. that's why this turn is forecast and it is forecast to miss the u.s., possibly not newfoundland or up here. we're talking about all the areas up here, atlantic canada, you are still in that but that's a seven-day cone they don't even make. we will keep watching that for you. so far, this is a very large storm. it continues to grow with time and the satellite makes it very strong eye tonight. in fact, we will get another update in just the next few minutes to see if they move it left or right. for now, it's on a big course and a path so far to miss the u.s. >> that's what we wanted to hear. so they don't make a seven-day cone? they got to get working on that. >> lucky to make a three-day cone. literally, the air gets so far left and right by five days, it's almost worthless. don't focus on that. these models can be off a lot.
4:36 pm
we'll see. >> i always learn a lot when we watch you. thank you, chad. well, the minnesota vikings say brett favre is coming back to the nfl and playing for them. 39-year-old favre is practicing with the team. you can see right there he's wearing old number 4. insiders had had expected him to come out of retirement for a two-year deal worth anywhere from $10 million to $12 million. now let me remind you, just a couple months ago, favre said he would not return. now, of course, favre's career has been a bit of a roller coaster ride for the past two years. he was retiring, coming out of retirement, switching teams multiple times. we are joined at the vikings training camp in eden prairie, minnesota with fan reaction. do tell. >> reporter: well, as you said, this has been quite the saga. i'm actually standing on the training field for the minnesota vikings. they i believe we're the only
4:37 pm
ones broadcasting live from the field today. it struck me, what are the minnesota fans here, and maybe some of the green bay packer fans, the team he used to play for, what do they think? today after weeks of i'm not going to join, i'm going to retire, today it sounds like it's going to be official. sorry, i'm playing with this. i will put this out for a second. it will be official today, we expect, in just about an hour and a half. i went to the mall of america, stood outside a vikings merchandise store, ran into a green bay packers fan, another woman, minnesota vikings fan. they happened to meet randomly. here's what happened. >> my feeling is first he retired, then didn't retire, then he retired, now -- i don't know, it's just to the point where kind of like when michael jordan retired 35 times, it kind of gets a little old and you know, i think, i mean, he was a great player and i'm a huge packer fan. it was a little disappointing. >> reporter: feel like a traitor? >> maybe not a traitor so much,
4:38 pm
but unfortunately, you're our sworn enemies this year in minnesota. so it's kind of like he's gone to the other side which is traitorous. but it's okay. we're forgiving. we're loving. we're in the midwest. we can stand next to each other and love each other anyway, even though she's -- >> reporter: training camp has been in progress since the 31st of last month, so he would have missed most of that at this point. now the first official game of the regular season is december 13. richelle? >> no more will he, won't he. i guess the question now is can he really do this. how does he look out there? >> reporter: well, you know, i just got here. it's hard for me to tell because really, i just scrambled to put the shot up, get you the field. judging from the amount of media here, this is going to be quite a show this afternoon. we'll see what he has to say if he does in fact speak. >> quite a show. you bet. that's the way to put it. i agree with you.
4:39 pm
well said. thanks, chris. appreciate it. all right. got a question for you. which would you choose, sex or sleep? the numbers are in. find out if you're in the majority. plus, an nba player smokes dope. but he says it's okay for him to light up. wait until you hear his reason.

sunday school teacher turned suspected killer, melissa huckabee has been indicted on kidnapping, rape and murder charges. she broke down in court yesterday as a judge read the indictment which was handed down by a grand jury. huckabee pleaded not guilty to murdering 8-year-old sandra cantu.
4:42 pm
sandra's body was found stuffed in a suitcase at an irrigation pond in april. huckabee also pleaded not guilty to charges of drugging a 7-year-old girl and a 37-year-old man whom police believe she dated at one point. a trial date has not been set just yet. kids are back with their mother after being kidnapped from their home early this morning. javier soto is in phoenix with more on their abduction and how the kids were found. >> how are they doing, officer? >> reporter: found safe. four and a half hours after these two kids were kidnapped. >> somebody beat on the door and i come and looked through the curtain, and saw them two babies out there screaming their head off. >> reporter: dick saw the brother and sister sitting on this rock outside his south phoenix home. scared and all alone. >> i didn't know what to do but i woke my wife up and we brought them inside. >> reporter: little did he know,
4:43 pm
2-year-old jesus and his 11 month old sister vanessa were part of an amber alert issued early this morning after four suspects busted into this home demanding money, then taking the two children. >> we're very concerned about the welfare of these two little children. the girl, vanessa, is 11 months old. obviously, her brother is 2 years old. we want to make sure suspects understand they need to drop these kids off at a safe place. >> reporter: the suspects did just that, leading to this reunion with worried family members. although the children are now safe, those responsible are still on the loose. >> by the time i looked, there wasn't nobody out here. >> reporter: the suspects are described as african-american men, seen leaving in a '90s style white japanese import, honda or toyota. if you have any information, you are urged to contact police. the good news is, the kids are back with their mother. javier soto, for hln.

a woman born without a left forearm has successfully sued her employer. we're talking about retail giant abercrombie & fitch. she sued for discrimination after she said they banished her from the floor to the stockroom. her story's getting a lot of attention today at cnn.com. katherine calloway joins us with this story.@y what are the details? >> reporter: abercrombie & fitch, surely you have seen their advertisements, you may have been in their store. they are known for their incredibly beautiful models, you know, the flawless bodies. well, this young girl says that she apparently didn't fit their ideal. the 22-year-old london law student tried to cover up her prosthetic arm, even buying a cardigan at her employer's request. listen to what she said happened. >> i originally asked to wear -- and they said that would be
4:45 pm
okay. could you purchase the cardigan, which i did. then they started having a problem with that cardigan and by my fifth or sixth shift, they decided that i shouldn't be seen and should work in the stockroom. >> reporter: her bosses said that she was moved because the sweater violated their quote, look policy. dean says the look policy was used as an excuse just to try and hire away. abercrombie has been blatant about its emphasis on looks. in fact, its ceo once said quote, we go for the cool kids. a lot of people don't belong and can't belong, are we exclusionary, absolutely. >> what? >> reporter: but a british panel apparently ruled they just went too far in how they treated dean, who is very beautiful, as you can see. she was awarded $15,000 in the discrimination case. abercrombie says the whole thing was just a misunderstanding. it's interesting, though, to remember that back in 2004, abercrombie was also in trouble
4:46 pm
and they actually settled some $41 million lawsuit by nine minority employees who say they were forced to go into the stockroom and work there because they say they didn't fit the ideal. so interesting on what's going to happen now. the good news is dean is apparently already getting job offers. >> good for her. i love that. that is the best way to wrap that up. nba point guard stefan marbury smokes dope on camera, says it's okay for him to light up. wait until you hear his reason. x

it was ten years in the making. we will talk to her as well about some of the stories we cover. i'm specifically going to ask her is there one of these stories, sandra cantu, casey anthony, that is tough to shake and you take home with you? we'll be asking nancy some of those questions. we'll take your calls as well. 1-877-tell hln is the number. you can e-mail us or text us. coming your way in about ten minutes. >> good stuff, mike. thank you. we got pictures just in to hln we want to show you. this is a severe storm in the beaumont, texas area. police have sealed off a shopping center because of destructive winds from a possible tornado and there is your picture right there. this is the roof of a kohl's department store that looks like it did collapse. some customers were hurt. we do not know how badly they were hurt. also, one exterior wall was torn away. again, from a storm in beaumont, texas that may have been a tornado. they're not sure. cars and trucks were flipped

over in the parking lot as well. wanted to get you those pictures. nba player stephon marbury smokes pot, apparently doesn't care who knows about it. he was seen smoking marijuana on camera on his own site. tmz posted two clips that appear to show him smoking a joint and one, he says i smoke marijuana, yep, you saw me. he says he does it occasionally, not when he's under contract or when he's driving. the former timberwolf is a free agent right now. he played last season for the celtics. an oklahoma judge has just ruled against a controversial anti-abortion law that would force women to get an ultrasound before an abortion. the judge says it violated state constitutional requirements that legislative measures deal only with one subject. critics say the law was unconstitutionally vague and didn't spell out what doctors should tell women who were undergoing the ultrasound. opponents argued it requires doctors to describe the fetus, its dimensions, heart activity and other physical details.

lawmakers originally passed the measure by overriding governor brad henry's veto. henry argued it was unconscionable to require victims of rape and incest to under go the ultrasound. more to come. )$)$)$)$)$)$)$$
